Mindpath Health $3.5M Data Breach Settlement

Current and former patients who received a notice from Mindpath Health about a data security incident in or around January 2023 or who received services from Mindpath before August 2022 may qualify to submit a claim for up to $50 or more from a class action settlement.

Community Psychiatry Management LLC, doing business as Mindpath Health, agreed to pay $3.5 million to settle a class action lawsuit. The lawsuit alleged that unauthorized parties accessed Microsoft Office 365 business email accounts in March and July 2022, exposing personally identifiable and protected health information of Mindpath patients and others.

Who is eligible for a data breach payment?

Class members must meet the following criteria:

  • Mindpath Health identified them as potentially impacted by the March 2022 or July 2022 data incidents.
  • They received a data breach notice from Mindpath Health or around January 2023.
  • They are a current or former patient who received services from Mindpath before August 2022.

The settlement also includes a California subclass of class members who resided in California at the time of at least one of the incidents and received notice at a California mailing address.

How much is the class action settlement payout?

  • Ordinary documented losses: Class members can claim up to $1,500 in ordinary documented losses traceable to the data breach. Losses may include credit monitoring costs incurred after the incident, fees for freezing or unfreezing credit, bank or credit card fees and unreimbursed fraudulent credit card or bank card charges.
    • Lost time: Class members may claim up to 10 hours of lost time spent dealing with issues the data breach caused at a rate of $30 per hour ($300 maximum). Lost time claims are included in the $1,500 ordinary losses claim cap.
  • Documented extraordinary losses: Class members can claim up to $10,000 in documented extraordinary losses related to the data incident. Losses must have occurred between March 2022 and Jan. 5, 2026, and not be covered by an ordinary losses claim. This may include fees and monetary losses related to falsified tax returns, loan fraud and identity theft.
  • Credit monitoring: All class members may elect to receive three years of one-bureau credit monitoring services.
  • Alternative pro rata cash payment: Class members who do not wish to receive free credit monitoring can elect to receive an alternative cash payment estimated at $50. The settlement administrator will determine the final payment amount by the number of valid claims.
  • California subclass statutory pro rata cash payment: Class members who were California residents at the time of at least one of the data incidents occurred and received their notice at a California mailing address will automatically receive a pro rata cash payment estimated at $50. The settlement administrator will determine the final payment amount by the number of valid claims.

How to claim a class action rebate

To receive certain settlement payments and credit monitoring, class members must submit a claim form by the deadline of Jan. 5. 2026. There are two ways to do this:

California subclass members who do not wish to submit a claim for ordinary losses, lost time, extraordinary losses, credit monitoring or the alternative cash payment will automatically receive the statuary cash payment.

Required proof and claim information

  • To submit a paper claim by mail, class members must provide the unique claim form identifier from their settlement notice.
  • To submit an ordinary loss claim, class members must provide supporting documentation, such as receipts or invoices for costs and services and bank or credit card statements showing fees or unreimbursed fraudulent charges.
  • To submit an extraordinary loss claim, class members must provide supporting documentation, which may include police reports, invoices for professional attorney or CPA fees, bank or credit card statements showing fees and unreimbursed charges and any other proof of identity theft and fraud, such as falsified tax returns or loan documents.
  • Class members who did not receive notice of the data incidents at a California address but resided in California at that time must contact the settlement administrator and provide documentation to receive a subclass statutory payment.

$3.5 million data breach settlement fund

The $3,500,000 settlement fund will include:

  • Settlement administration costs: Up to $202,900
  • Attorneys’ fees: $1,166,666.67
  • Attorneys’ expenses: Up to $35,000
  • Service awards to class representatives: $5,000 each ($15,000 total)
  • Credit monitoring: Cost determined by the number of approved claims
  • Payments to eligible class members: Remaining settlement funds

  • Final approval hearing: Feb. 19, 2026

When is the Mindpath Health data breach settlement payout date?

The settlement administrator will distribute payments to valid class members approximately 60 days after the court grants final approval of the settlement.

Why did Mindpath Health settle this class action lawsuit?

The class action lawsuit alleged unauthorized parties accessed Mindpath’s Microsoft Office 365 business email accounts in March and July 2022, exposing patients’ personally identifiable and protected health information.

Mindpath Health denies any wrongdoing but agreed to settle to avoid the expense, burden, and risk of further litigation.
